Atul, an automobile company employee, allegedly took his life on December 9 after citing relentless harassment and a demand for Rs 3 crore as part of a divorce settlement. He left behind a 90-minute video and a 40-page note detailing the alleged pressures from his wife and her family.

Accusations and Child Custody Concerns

Atul’s family, represented by advocate Akash Jindal, opposes granting bail to Nikita and other accused parties, asserting that the child is being used as leverage. Jindal emphasized the severity of the alleged crimes and argued for the child’s custody to remain with Atul’s family for his safety. These reasons also lead them to oppose bail for Nikita Singhania.

“The family is gravely concerned about the child’s wellbeing,” stated Pavan Kumar Modi, Atul’s father. He alleged that Nikita’s demands for financial support under the pretext of caring for the child were exploitative. The family also cited fears that granting bail could endanger the child’s life.

Adding to the tension, Atul’s brother, Bikas Kumar, acknowledged the police department’s cooperation but expressed frustration over the uncertainty surrounding the child’s whereabouts. The family has filed a habeas corpus petition before the Supreme Court to locate the child and secure custody.

Counter-Allegations and Legal Challenges

Nikita’s family has countered the allegations, claiming Atul had demanded excessive dowry, which they allege led to the death of her father. These accusations have further complicated the case, with both sides presenting contrasting narratives in court.

The Bengaluru police have charged Nikita, her mother, and brother under Sections 108 and 3(5) of the Bharatiya Nyay Sanhita (BNS), following a complaint by Bikas Kumar alleging abetment to suicide. The accused have been placed under 14-day judicial custody.

Awaiting Key Legal Decisions

As the legal proceedings unfold, the Supreme Court is set to hear the habeas corpus petition on January 7. The decision will play a critical role in determining the child’s custody and possibly influence the bail hearing scheduled earlier.

This high-profile case underscores the complexities of familial disputes intertwined with allegations of harassment and financial demands, setting the stage for a contentious courtroom battle. Both parties now await the judiciary’s verdict to navigate the path forward.
